Platform & Payment Role Disclosure
Omniscan operates solely as a technology infrastructure platform. Omniscan is not a retailer, payment processor, financial institution, or merchant of record.
All purchases, membership transactions, subscriptions, and financial transfers are processed directly by licensed third-party payment providers including PayPal. Omniscan does not collect, receive, store, transmit, or have access to users’ credit card numbers, bank account details, or other financial credentials at any time.
Payment authorization occurs exclusively between the user and the external payment provider. Omniscan receives only limited transaction confirmation data necessary to operate the platform, such as transaction identifiers and payment status.
1. Platform Nature & Members
Omniscan is a technology platform that enables product discovery, verification, and transaction coordination between consumers and independent Members (retailers, brands, or organizations). Transactions occur directly between consumers and Members. Consumers are not required to create accounts to use core features.
2. Public API Recall System Disclosure
Recall and safety information displayed within Omniscan is obtained from publicly available governmental and third-party data sources accessed through public APIs. Omniscan does not create, verify, certify, or independently validate recall data and makes no guarantees regarding completeness, accuracy, timeliness, or availability of such information. Users must verify recall information with the original issuing authority before making safety decisions.
3. Limitation of Liability
To the maximum extent permitted by law, Omniscan's total liability arising from or relating to the service shall not exceed the total amount paid by you to Omniscan during the twelve (12) months preceding the event giving rise to the claim. IN NO EVENT SHALL OMNISCAN BE LIABLE FOR INDIRECT, SPECIAL, OR CONSEQUENTIAL DAMAGES.
4. Binding Arbitration & Class Action Waiver
ANY DISPUTE WILL BE RESOLVED BY BINDING ARBITRATION RATHER THAN IN COURT. BY AGREEING TO THESE TERMS, YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
5. No Personal Guarantee
Nothing within these Terms shall be interpreted as creating a personal guarantee, personal warranty, or individual obligation by any founder, operator, or representative of Omniscan.

Infrastructure Disclosure
Omniscan provides technology infrastructure only and is not the seller of record for products offered by Members. Omniscan never receives financial credentials.
1. Payments and Financial Processing
Members acknowledge that Omniscan does not act as a payment processor, escrow agent, bank, or financial intermediary. Payments are processed entirely through third-party providers selected by the platform. Members are responsible for maintaining active accounts with the designated payment provider in order to receive funds. Omniscan does not hold sponsor funds or store banking credentials.
2. Payment Split Disclosure
Members acknowledge that payments may be automatically divided by the payment processor between the Member and Omniscan as a platform service fee (typically an 85/15 split). Omniscan does not manually distribute funds or hold transaction balances.
3. Member Responsibilities
Members are solely responsible for product accuracy, pricing, regulatory compliance, recalls issued by manufacturers or authorities, and customer service obligations.
4. QR Confirmation
Certain transactions require QR code confirmation to verify fulfillment. The QR confirmation constitutes proof of completion between the consumer and the Member.
Consumer Privacy Policy
Omniscan operates using a data-minimization architecture. We prioritize the display of public information without persistent user profiling.
1. Payment Information
Omniscan does not collect or store financial payment credentials. All payment information is entered directly into secure systems operated by third-party payment processors such as PayPal. Because payment data is never transmitted through or stored on Omniscan servers, Omniscan cannot access, retrieve, modify, or disclose users’ card or banking information.
2. Public API Data
Product scans and recall checks are processed temporarily using public API requests. These requests are not stored as persistent personal profiles and are generally deleted or anonymized after approximately thirty (30) days.
3. User Data Rights
Because Omniscan does not maintain consumer accounts or retain personal identity information, requests for access, correction, portability, or deletion will generally result in confirmation that no personal data is stored by Omniscan. For third-party data, users must contact processors directly.
Marketplace Refund Policy
Refunds are processed as reversals of original transactions to maintain the integrity of the technology platform model.
1. Eligibility
Refund requests may be initiated through Omniscan within thirty (30) days of purchase. Completion requires in-store QR verification by the Member.
2. Processing Flow
Approved refunds are executed solely by the payment processor. Amounts are proportionally allocated according to the original payment split between the Member and Omniscan. Omniscan does not independently transfer funds or issue payments.
Platform Infrastructure
Omniscan provides sovereign auditing tools, automated product insight technology, and transaction coordination infrastructure connecting consumers and independent Members.
Omniscan operates solely as a technology platform and is not:
- a retailer,
- a distributor,
- a marketplace seller,
- a financial institution,
- an escrow service,
- a logistics provider, or
- the seller of record for any product.
Technology Role
Omniscan enables product discovery, recall verification using publicly available APIs, QR-based transaction confirmation, and automated payment coordination through third-party processors.
Independent Members
All products, pricing, warranties, representations, and fulfillment obligations are determined solely by participating Members. Members act as independent businesses and not as agents, employees, or partners of Omniscan.
Transaction Coordination
Omniscan may facilitate automated payment splitting and confirmation mechanisms; however, funds are never held, controlled, or manually distributed by Omniscan.
Public Data Sources
Recall alerts and safety notices are obtained from governmental or third-party public APIs. Omniscan does not originate recall decisions or certify product safety.
No Ownership of Transactions
Legal ownership of purchases exists exclusively between the consumer and the Member. Omniscan does not assume contractual responsibility for product performance, delivery outcomes, or refund eligibility.
Infrastructure Availability
Omniscan provides services on an “as-available” basis and does not guarantee uninterrupted availability of platform infrastructure, integrations, or third-party services.
Infrastructure Security
Omniscan is built using a data-minimization architecture designed to limit the collection, storage, and exposure of personal information.
Data Minimization by Design
Omniscan does not request, receive, process, or store consumer financial credentials, including credit card numbers, banking information, or payment authentication data.
Third-Party Payment Processing
All payments are processed exclusively by regulated third-party payment processors, including but not limited to PayPal. Financial data is submitted directly to the payment processor using encrypted connections. Omniscan systems do not have access to full payment credentials at any time.
Temporary Operational Data
Limited technical information such as anonymous device identifiers, transaction confirmation tokens, QR verification states, and recall API queries may be processed temporarily to enable platform functionality. Such data is automatically deleted after operational necessity expires, typically within thirty (30) days.
Encryption & Transmission Security
All communications between user devices, Members, and Omniscan services are transmitted using industry-standard encrypted protocols (HTTPS/TLS or successor technologies).
Access Control
Administrative access to platform infrastructure is restricted using role-based authorization, authentication safeguards, and monitoring controls intended to prevent unauthorized system interaction.
No Persistent Consumer Profiles
Consumers are not required to create accounts. Omniscan does not maintain persistent personal identity databases for general platform usage.
Security Responsibility Allocation
Security of payment credentials, identity verification, and financial account protection remains the responsibility of the licensed payment processor.
Incident Response
In the event of a confirmed security incident affecting systems under Omniscan’s control, notifications will be provided as required under applicable Canadian privacy laws, including PIPEDA.
Member Privacy Policy
We collect business contact information and operational analytics necessary to provide platform features to Members. Financial credentials are stored only by payment processors.
Acceptable Use
Prohibited: Scraping, reverse engineering, fraud, or bypassing payment flows. All activity must comply with Canadian federal and provincial laws.
